Terms of Service - Hosting Nigeria

This Policy governs the use of Hosting Nigeria’s web hosting and related services. Violation of these Terms may result in suspension or termination of your service. In the event of any dispute regarding the interpretation of this Policy, Hosting Nigeria’s reasonable commercial judgment shall prevail.

1. General Terms

This document represents the complete Terms of Service agreement between Hosting Nigeria and the account holder (individual or corporate). Hosting Nigeria provides web hosting, domain registration, website design, and related services.

As a responsible service provider, Hosting Nigeria maintains certain legal and ethical obligations regarding the use of its servers and equipment. We reserve the right to suspend or terminate any account found to be misused or in violation of these Terms.

2. Privacy Guarantee

Hosting Nigeria values your privacy. All client contact details are securely stored and will never be shared with third parties without consent. For more information, please refer to our [Privacy Policy].

3. Uptime Guarantee

Hosting Nigeria guarantees 99.95% uptime across all hosting services.
Please note that scheduled maintenance periods are excluded from this uptime percentage, as prior communication will be provided to affected users.

4. Technical Support

We provide 24/7 technical support throughout the year via phone, live chat, email, and ticketing. Our team is always available to assist with technical or account-related issues.

5. Payments and Renewals

Hosting Nigeria accepts payments via Bank Transfer, PayPal, and other supported local gateways.

Services are offered for fixed billing periods based on your subscription and must be renewed before the expiry date to avoid suspension.

We send renewal notifications as follows:

60 days before expiry
30 days before expiry
10 days before expiry
On the day of expiry

If payment is not received by the expiry date, your service will be suspended. Access will be restored only after full payment is received.

Customers who do not intend to renew are advised to back up their data before the expiry date. Hosting Nigeria will not be responsible for data loss resulting from expired or terminated services.

Service termination timelines:

Shared & Reseller Hosting: 30 days after expiry
VPS & Dedicated Servers: 3 days after expiry
Other Services: Within 24 hours after expiry

In some cases, termination may occur immediately upon non-renewal (e.g., if a cancellation was requested before the renewal date).

6. Limitation of Liability

All services provided by Hosting Nigeria are offered “as is”, without any warranties—express or implied—regarding merchantability, fitness for a specific purpose, or non-infringement.

Hosting Nigeria does not guarantee:

Uninterrupted or error-free service
That our services will meet your specific needs
That downloaded data will be free from damage or loss

You acknowledge that Hosting Nigeria will not be liable for:

Service suspension or downtime
Business interruption
Data loss or corruption
Acts beyond our control (e.g., natural disasters, network failures)
Unauthorized use of your account credentials

Our total liability shall not exceed the amount paid for the specific service in question.

No waiver of any provision shall be valid unless in writing and signed by an authorized representative of Hosting Nigeria.

7. Refund Policy

Hosting Nigeria does not offer refunds for services rendered, including:

Domain registrations or transfers
Hosting account setup
Server provisioning
SSL installations
Website creation

Refunds are only issued for:

Duplicate payments
Overpayments
Erroneous transactions with no active service attached

8. Account Activation

Web Hosting: Activated instantly
Temporary Hosting: Within 24 hours
VPS Servers: Activated within 2 hours
Dedicated Servers: Activated within 6 hours

9. Content and Prohibited Use

Customers agree to use our services only for lawful purposes. The following are strictly prohibited:

Pornography or sexually explicit content
Child exploitation material
Hate speech, threats, or violence-inciting content
Defamatory or deceptive material
Copyrighted material without proper authorization
Promotion of illegal drugs, arms trafficking, or gambling
Hosting hacking tools, exploits, or warez
Running proxy scripts or background processes on shared servers
Bulk email (spam) activities

Hosting Nigeria may suspend or terminate any account found in violation, without refund.

Clients are responsible for keeping their scripts, plugins, and CMS installations secure and updated at all times. Strong passwords must be used.

Customers must also keep their contact email and billing information updated, as this is the primary channel for official communication.

10. Domain Registration and Transfer

Domains registered or transferred to Hosting Nigeria must remain with us for a minimum of 60 days before becoming eligible for transfer out.

If a domain transfer is requested before this period, an additional fee may apply. International domains will only be transferable after 60 days.

11. Cancellations

Cancellation requests must be submitted via the client dashboard or by emailing support from your registered account.
Only official cancellation requests will be considered valid.

12. Anti-Spam Policy

Hosting Nigeria enforces a zero-tolerance policy against spam.
Accounts found sending spam will be immediately suspended. Repeated violations may result in permanent termination.

Bulk email is not permitted on shared hosting plans. Businesses requiring mass email services should contact us for a suitable plan.

13. Resource Usage

All hosting accounts must operate within the allocated CPU, memory, and disk space limits.
Excessive resource usage that affects server stability may result in temporary suspension until corrective action is taken.

14. Hosting Transfers

Hosting Nigeria provides courtesy website transfer services during the first 30 days of signup.
However, we do not guarantee the success or speed of a migration, as compatibility varies between hosting providers.

15. Backups

Clients are responsible for maintaining regular backups of their data.
While Hosting Nigeria may offer backup solutions, customers remain solely responsible for ensuring their data is safely stored.

16. User Content

“User Content” refers to any material uploaded or distributed through your hosting account or website.
You are solely responsible for ensuring that such content:

Does not violate any third-party rights
Is lawful and appropriate

Hosting Nigeria does not monitor user content but reserves the right to remove or suspend any content or account that violates these Terms.

17. Changes to Terms

Hosting Nigeria reserves the right to modify these Terms of Service at any time without prior notice.
